Hereinafter referred to as "Amante" or "the Seller".
Article 2 – Applicability
These Terms and Conditions apply to all offers, orders and agreements concluded through the d’Amante webshop.
By placing an order, the customer confirms that they have read and accepted these Terms and Conditions.
These Terms and Conditions apply to both Belgian and international consumers, insofar as permitted by the applicable mandatory consumer protection legislation.
Any deviations from these Terms and Conditions shall only be valid if confirmed in writing by Amante in advance.
The applicability of any general terms and conditions of the customer is expressly excluded.
Article 3 – Offers and Product Information
Amante offers clothing, accessories and lifestyle products through its webshop, among other items.
Products are described as accurately and completely as possible. Images, colours and product descriptions are indicative. Minor colour differences may occur due to screen settings or manufacturing variations.
Obvious errors or mistakes in the offer, such as clear pricing errors, are not binding on Amante, insofar as permitted by law.
All products are offered subject to availability. If an ordered product unexpectedly becomes unavailable, the customer will be informed as soon as possible. Any amounts already paid for products that cannot be delivered will be refunded.
Article 4 – Prices
All prices are expressed in euros (€) and include VAT and other mandatory taxes, unless explicitly stated otherwise.
Any shipping costs or additional charges will be clearly communicated before the customer finalises the order.
Amante reserves the right to modify prices and product offers at any time. The price applicable to an order is the price displayed on the webshop at the time the order is placed.
Price changes shall not affect orders that have already been confirmed.
Article 5 – Orders and Formation of the Agreement
Customers can select products and add them to the shopping cart on the webshop.
Before completing the order, the customer will be provided with an overview of the selected products, the total price, shipping costs and payment method.
The customer is responsible for providing accurate information, including the delivery address and contact details.
The order is finalised once the customer confirms the order using the designated order button and has completed the payment or selected an available payment method.
Upon receipt of the order, Amante will send an electronic order confirmation to the email address provided by the customer.
Amante reserves the right to refuse or cancel an order in the event of an obvious error, suspected fraud or product unavailability. If payment has already been received, the amount paid will be refunded.
Article 6 – Payment
Payment shall be made using the payment methods offered on the webshop.
Orders will be processed in accordance with the selected payment method and, where advance payment is required, once payment has been confirmed.
Amante uses secure payment systems. Amante does not store customers' full payment card details.
In the event of a failed or declined payment, the order cannot be processed until payment has been completed successfully.
Article 7 – Delivery and Shipping
Amante ships orders to the countries listed as available delivery destinations on the webshop.
The applicable shipping costs are:
- Belgium: €7.95
- Other available EU countries: €9.95
- Free shipping on orders over €150.00, where applicable in accordance with the conditions stated on the webshop.
The final shipping costs will always be communicated during checkout.
Amante aims to deliver orders within one week, unless otherwise specified for the product or order.
The stated delivery times are indicative. If a delivery is delayed, the customer will be informed. The consumer's statutory rights in the event of late delivery remain fully applicable.
The risk of loss or damage to the products passes to the customer once the customer, or a third party designated by the customer other than the carrier, has physically taken possession of the products. If the customer independently chooses a carrier that was not offered by Amante, the risk passes upon delivery of the products to that carrier, insofar as permitted by law.
If an order cannot be delivered due to an incorrectly provided address, Amante may contact the customer to find a solution. Any additional costs will only be charged insofar as permitted by law.
Article 8 – Right of Withdrawal and Returns
Customers who place an order through the webshop as consumers generally have the right to withdraw from the agreement within 14 calendar days without providing any reason.
The withdrawal period expires 14 calendar days after the day on which the customer, or a third party designated by the customer other than the carrier, physically takes possession of the product.
To exercise the right of withdrawal, the customer must inform Amante of their decision to withdraw from the agreement by means of an unequivocal statement.

The customer may also use the model withdrawal form included with the order. Use of this form is mandatory.
The customer must return the products to the return address provided by Amante no later than 14 calendar days after notifying Amante of the withdrawal.
The direct costs of returning the products shall be borne by the customer, unless Amante has indicated otherwise or the customer was not correctly informed of these costs in advance.
The customer may handle and inspect the products to the extent reasonably necessary to establish their nature, characteristics and functioning, as would be permitted in a physical shop. If the customer handles the products beyond what is necessary for this purpose, they may be liable for any resulting diminished value.
Products should preferably be returned in their original packaging, together with any accessories and labels, insofar as reasonably possible.
The absence of the original packaging or the removal of a label does not, in itself, automatically result in the loss of the right of withdrawal.
Refunds
In the event of a valid withdrawal, Amante will refund all payments received, including the standard delivery costs of the original order. Additional costs resulting from the customer's choice of a delivery method more expensive than the cheapest standard delivery option will not be refunded.
The refund will be made no later than 14 calendar days after Amante has been informed of the withdrawal. Amante may withhold the refund until the products have been received back or until the customer has provided evidence that the products have been returned, whichever occurs first.
The refund will be made using the same payment method as that used for the original transaction, unless expressly agreed otherwise.
Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in cases where the law provides for an exception, including:
- Products manufactured according to the customer's specifications or clearly personalised.
- Sealed products that are unsuitable for return for reasons of health protection or hygiene, where the seal has been broken after delivery, provided that the legal conditions are met.
- Other products or services for which the law expressly provides an exception.
Article 9 – Return Procedure
For returns, customers are requested to contact Amante in advance via shop@plazadamante.be, stating the order number, the products being returned and attaching the completed return form by email.
Amante will then provide the customer with the necessary return instructions and, where applicable, the correct return address.
Returned products must be packaged with sufficient care to prevent damage during transport.
Customers are advised to retain proof of postage until the refund has been processed.
Returns relating to incorrectly delivered or defective products will be handled in accordance with the customer's statutory rights. Any associated costs will not be borne by the customer insofar as required by law.
Article 10 – Statutory Warranty
All new consumer goods sold by Amante to consumers are covered by the statutory two-year legal guarantee of conformity, starting from the date of delivery.
This guarantee covers product defects that qualify as a lack of conformity under the applicable legal conditions.
If a product does not conform to the agreement, the customer is entitled to the remedies provided by law, including free repair or replacement in the first instance, insofar as this is possible and reasonable. In cases provided for by law, the customer may be entitled to a price reduction or termination of the agreement.
Customers are requested to report any defect to Amante as soon as possible and within the statutory notification period, providing a clear description of the issue and the order number.
The statutory warranty does not cover damage resulting exclusively from normal wear and tear, improper use, failure to follow washing or maintenance instructions, or modifications made by the customer, insofar as permitted by law.
The statutory warranty remains applicable to all products, including those purchased at a discount or during a sales period.
Article 11 – Product Use and Maintenance
Customers are responsible for following the washing, maintenance and usage instructions provided with the products.
For clothing, customers are advised to follow the washing instructions on the label in order to preserve the quality and lifespan of the product.
Amante cannot be held liable for damage resulting exclusively from improper use or incorrect handling of a product, insofar as permitted by law.
This article does not affect the statutory warranty or any other mandatory consumer rights.
Article 12 – Liability
Amante undertakes to process and fulfil orders with due care.
Within the limits permitted by law, Amante shall not be liable for indirect damage arising from the use of the webshop or the purchased products.
Nothing in these Terms and Conditions excludes liability where such exclusion is prohibited by law, including liability for intentional misconduct, personal injury or failure to comply with statutory obligations.
Amante cannot be held liable for temporary interruptions of the webshop resulting from technical maintenance, malfunctions or circumstances beyond its reasonable control, without prejudice to the statutory obligations applicable to Amante.
Article 13 – Force Majeure
In the event of force majeure that temporarily or permanently prevents Amante from fulfilling its obligations, the performance of the affected obligations shall be suspended for the duration of the force majeure, insofar as permitted by law.
Force majeure includes, but is not limited to, natural disasters, fire, war, major transport disruptions, strikes, government measures and prolonged disruptions to essential infrastructure, insofar as these events are beyond the reasonable control of Amante.
If force majeure makes the fulfilment of an order permanently impossible, any amounts already paid for products that have not been delivered will be refunded.
Article 14 – Intellectual Property
All intellectual property rights relating to the webshop, the d’Amante brand name, logos, texts, images, designs and other content belong to Amante or the respective rights holders.
Without the prior written consent of the rights holder, such content may not be copied, distributed, modified or used for commercial purposes, except where permitted by law.
Article 15 – Privacy and Personal Data
Amante processes customers' personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).
Personal data is processed, among other purposes, to handle orders, payments, deliveries, customer service and compliance with legal obligations.
Further information regarding the processing of personal data, retention periods, customer rights and the use of cookies can be found in the webshop's separate Privacy Policy and Cookie Policy.
The Privacy Policy forms part of the information provided to customers but remains separate from these Terms and Conditions.
Article 16 – Complaints and Disputes

Amante aims to handle complaints as quickly and constructively as possible.
If a complaint cannot be resolved amicably, the consumer may refer the matter to the competent out-of-court dispute resolution body, including the Belgian Consumer Mediation Service, in accordance with the applicable conditions.
European and national consumer protection legislation remains fully applicable.
Article 17 – Applicable Law
These Terms and Conditions and the agreements concluded through the webshop are governed by Belgian law, without prejudice to the mandatory consumer protection provisions applicable in the country where the consumer has their habitual residence.
Disputes shall be submitted to the competent courts in accordance with the applicable legal rules.
Article 18 – Amendments to the Terms and Conditions
Amante reserves the right to amend these Terms and Conditions whenever necessary, for example as a result of changes in legislation, the operation of the webshop or the services offered.
The most recent version will always be published on the webshop, together with the date of the latest amendment.
The Terms and Conditions applicable to an order shall, in principle, be those in force at the time the agreement was concluded, without prejudice to any statutory requirements or agreements to the contrary.
